Secured funding for school serving at-risk children in New York
In a case bridging the lines of white-collar criminal defense and civil litigation, in January 2023, the founder of a prominent school that received funding from federal and New York City agencies such as ACS, was indicted and charged with multiple crimes, such as federal program theft. Dynamis was quickly retained to represent the company. The company nearly collapsed because every agency immediately cut off funding. Dynamis, however, fought back in both the courts and in administrative proceedings. After months of unsuccessful negotiations, Dynamis attorneys, led by Eric Rosen, convinced ACS (Administration for Childrens Services) that the school had been operating properly and above-board. ACS then repaid to the school nearly $7 million in previously withheld grants and reimbursements for childcare services. Dynamis’ actions ultimately saved the school from collapsing, and further prevented the loss of hundreds of jobs.
This is an example of the aggressive, out-of-the-box styles of advocacy that Dynamis attorneys are known for. We’re continuing the fight on behalf of the school, and are currently seeking restitution by filing a “mandamus” action in the Second Circuit Court of Appeals under the Crime Victim Rights Act.
