Motion to Stay Dismissal of Indictment: Denied

A brief update after our whirlwind week securing the dismissal of the Indictment in the Atlas Trading case. A few days after the Court dismissed the Indictment, the Government, on Friday, March 22, 2024, moved to stay the dismissal of the Indictment. The Government’s brief is set forth below.

Our response to the Government’s motion to stay filed just two days later on March 24, 2024, pointing out the jurisdictional issues with filing to stay the dismissal of a case that had already been dismissed, as well as the merits of the case.

On April 3, 2024, the Court denied the Government motion to stay the dismissal of the case.
