Dynamis LLP Beats SEC at Trial, Secures Across-the-Board Victory for Client in Federal Court in Boston

Dynamis LLP attorneys Michael Homer and Constantine Economides recently obtained a complete trial victory against the SEC on behalf of Dynamis client and financial services professional, Tom Capellini. Mr. Capellini and his brother-in-law, Roger Bendelac, were wrongfully accused by the SEC of securities fraud and a host of other violations of the U.S. securities laws, stemming from an alleged pump-and-dump scheme. Following a four-day bench trial in federal court in Boston, Judge Richard Stearns of the U.S. District Court for the District of Massachusetts agreed with the defense, and found that the SEC failed to prove any of its claims against Capellini and Bendelac. Details regarding the trial can be found below, in Judge Stearns’ order vindicating our client.

This victory is a testament to our firm’s commitment to defending individuals against government overreach. Securities fraud allegations carry severe professional, financial, and reputational consequences, but this case demonstrates that when aggressively challenged, even the SEC can be defeated.

Dynamis congratulates partners Michael Homer and Constantine Economides on their trial victory. Dynamis also congratulates, and thanks, Aaron Katz and Keira Grimes Zirngibl of Aaron Katz Law LLC, stellar defense attorneys who successfully represented co-defendant Roger Bendelac and obtained a complete trial victory for their client as well.
